For the most part, those construction disputes that cannot be settled by the parties are still resolved by arbitration. We recognise that there will always be some instances where a binding solution will have to be imposed on the parties by a neutral, preferably technical, expert. Latterly, arbitration has begun to mimic litigation and is now plagued with the same disadvantages of extensive delays and high costs. We believe it is possible to restore arbitration to its rightful place as a viable alternative to litigation, re-emphasising the original goals whilst preserving the rules of natural justice. The interests of all parties are best served by initiating proceedings with the minimum delay, whilst the project is still ongoing and before the areas of dispute are compounded to create greater conflict.
